Joseph W. Booth, JD, M.Div.

About Joseph,

Today’s physicians and midwives spend the majority of their early careers learning how to administer care. So much so that learning the legal and business aspects of running a practice simply isn’t feasible. The legalities surrounding maternity care require careful navigation by a knowledgeable advocate.

Joseph W. Booth brings more than 25 years of legal experience to this work, with a career deeply rooted in family law, appellate practice, and assisted reproductive technology. Licensed in both Kansas and Missouri, Joe has spent decades helping clients navigate complex issues including divorce, parentage, custody, adoption, surrogacy, and interstate or international family law.

Joseph Booth, JD, M.Div

Since 2009, he has led The Law Offices of Joseph W. Booth in Lenexa, Kansas, focusing on family law and reproductive technology matters. Earlier in his career, he was a partner at Nelson & Booth, practiced with Payne & Jones, and served as legal counsel to the Kansas Health Care Stabilization Fund. In addition, Joe has provided service as Judge Pro Tem for Johnson County District Court since 2003, presiding primarily over family law cases.

Alongside his legal practice, Joe has served as an Adjunct Professor at Washburn University School of Law, teaching courses on Collaborative Law and the financial aspects of divorce. He is also a Fellow of both the American Academy of Matrimonial Lawyers and the International Academy of Matrimonial Lawyers, and has contributed to numerous national committees within the American Bar Association’s Family Law Section.

Joe’s expertise is widely recognized through his published appellate cases, legal articles, and frequent speaking engagements on complex family law issues, including surrogacy, custody, UIFSA (Uniform Interstate Family Support Act), and ethical practice. His academic foundation is equally distinguished — he earned his Juris Doctor, cum laude, from Washburn University School of Law (top 5% of his class) and a Master of Divinity, with honors, from St. Paul School of Theology.

At Grow Midwives, LLC®, Joe offers unique insight into the contractual and legal considerations that affect midwifery practices and maternity care. While his role is consultative — not legal representation — his depth of experience provides invaluable perspective for midwives, hospitals, and birth centers seeking to build sustainable, legally sound practices.

Joe is the lead author on three key White Papers that address key issues in midwifery: Vicarious Liability, Fair Market Salary Caps for Midwives, and Incident-To Billing. These white papers are free for download on the News and Articles Tab.
